Terms of Use

These statutory Terms of Use govern the contractual relationship between Wumi Healthcare ("the Company", "we", or "us") and the domestic clients, family proxies, and healthcare institutions ("the Client", "you") utilizing our services.

1. Primary Medical & Emergency Disclaimer

Wumi Healthcare is an institutional provider of non-clinical home assistance, hospital family support, vital signs tracking, and professional care monitoring delivered by qualified personnel where clinical care is required. We do not act as an emergency paramedic unit, nor do we replace a licensed primary diagnostic physician. In the event of an acute medical crisis (such as cardiac arrest, severe hemorrhaging, or stroke), the Client or family proxy agrees to immediately contact state emergency services (991) or transport the patient to the nearest hospital casualty department.

2. Execution of Services

No placement is deemed active until a formal Wumi Care Assessment has been completed by our Care Coordinators, and an individualized Care Plan has been signed by the legal family proxy or facility matron. Caregivers are strictly barred from performing tasks outside the written boundaries of this signed plan (e.g., administering unprescribed intravenous medications or executing manual home repairs).

3. Client & Domestic Environment Obligations

To ensure the profound safety and dignity of our deployed staff, the Client agrees to provide a safe, hazard-free domestic working environment. This strictly requires:

  • Ensuring all domestic guard dogs or aggressive pets are safely secured during caregiver shift arrivals and departures.
  • Providing access to clean, running water, basic sanitation, and adequate interior lighting for the professional to execute their hygiene duties.
  • Maintaining a zero-tolerance environment for verbal, physical, or sexual harassment directed toward any Wumi personnel. Wumi Healthcare reserves the absolute right to terminate care instantly, without refund, if our staff are subjected to abuse.

4. Scheduling, Alterations & Cancellations

Care assistance operates on carefully synchronized clinical rosters. Consequently:

Cancellations or shift alterations must be communicated to the Lusaka Coordinator desk at least twenty-four (24) hours prior to the scheduled start time.

Late Cancellations

Cancellations made inside of 12 hours will be billed at 50% of the scheduled shift rate to compensate the blocked professional.

5. Non-Solicitation / Anti-Poaching Covenant

Wumi Healthcare invests heavy financial and clinical resources into the vetting, auditing, and continuous professional development of our staff. The Client explicitly agrees that during the active term of this agreement, and for a period of twelve (12) months following its termination, they will not directly or indirectly solicit, employ, or privately contract any Wumi professional introduced to them. In the event of a breach of this covenant, the Client agrees to pay Wumi a liquidated recruitment placement fee equivalent to ZMW 45,000 per solicited professional.

6. Fees, Billing & Currency Terms

All standard domestic billing is rendered in Zambian Kwacha (ZMW). For international clients acting as proxies for Lusaka residents (The Diaspora), invoices may be settled via designated international wire or approved digital merchant gateways, converted at the prevailing Bank of Zambia mid-rate on the date of billing. Short-term and hospital relief plans operate on a pre-paid or statutory deposit basis.

7. Limitation of Liability

To the maximum extent permitted by Zambian law, Wumi Healthcare, its directors, and its clinical advisors shall not be held liable for any indirect, incidental, or consequential losses, nor for unavoidable domestic deterioration of chronic conditions occurring during standard support monitoring. Our total cumulative aggregate liability for any substantiated claim arising out of these services shall be capped at the total monetary sum paid by the Client to Wumi during the thirty (30) days preceding the incident.

8. Governing Law & Dispute Resolution

These Terms shall be interpreted in absolute accordance with the laws of the Republic of Zambia. Any dispute, controversy, or claim arising out of or relating to this contract shall be settled amicably through primary mediation handled by our Executive Advisory Desk. Failing mediation, the dispute shall be referred to the exclusive judicial jurisdiction of the High Court of Zambia sitting in Lusaka.

By issuing a care inquiry, signing a Wumi Care Plan, or permitting our staff entry into your domestic home or hospital ward, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Use.
